Terms and Conditions of Participation to the World Space Risk Forum 2022

 

1.     Terms

These Terms and Conditions (as defined below) set out the terms, conditions and rules for the:

(i) purchase and use of Tickets (as defined below) for the Event (as defined below); and

(ii) for admission to the Event.

By purchasing, accepting, holding and/or using a Ticket, the Participants (as defined below) accept and agree to comply with these Terms and Conditions including, for the avoidance of doubt, the Privacy Policy and the COVID-19 Policy.

By accepting and agreeing to all these Terms and Conditions, the Participants agree and consent to WSRF (as defined below) collecting and processing personal data for the purpose of the organisation and administration of WSRF and the Event, relevant events and for the marketing purposes of WSRF, its partners, event organisers and sponsors. Whenever and wherever possible, WSRF will treat the information provided with utmost care and confidentiality, in accordance with applicable laws. Reference is to be made to the Privacy Policy (as defined below) for detailed information about which and how data is used. The Participant further agrees to respect all terms and conditions, including security conditions, defined by the Event Site (as defined below).

The Participants shall comply with these Terms and Conditions. The possession of a valid and Ticket is a mandatory condition to participate in the Event. In case the Purchaser is not the Participant, these Terms and Conditions shall apply adequately to the Purchaser.

2. Definitions and Interpretations

In these Terms and Conditions, the following words and phrases shall have the following meanings:

"Attendee" means any Person taking part in the Event as a member of the general audience and not as a Sponsor or Speaker.

"Event" means the 2022 edition of World Space Risk Forum, which is to be held in Dubai, the United Arab Emirates, between 22 February 2022 and 24 February 2022.

"Event Site" shall mean the locations at which the Event shall take place. The address of the Event Site will be communicated to each Participant by the WSRF.

"Event Staff" shall mean all official staff, volunteers and third parties appointed by WSRF including, but not limited to, security and external emergency services.

"Force Majeure" means any cause or event beyond the control of WSRF including, without limitation, Royal bereavement, pandemic, fire, flood, earthquake, strike, lock-out, public health emergency, acts or regulations of government, national calamity or riot, civil commotion, malicious damage, act of God, explosion, war, weather, any cause or event arising out of or attributable to terrorism, or any other event (whether of a similar or dissimilar nature) beyond the reasonable control of WSRF. 

"Participant" means any Person taking part in the Event as an Attendee, Sponsor or Speaker.  

"Purchaser" means a Person who has purchased a Ticket. 

"Person" means an individual, partnership, firm, corporation, association, trust, unincorporated association or any other legal person.

"Privacy Policy" means WSRF’s policy regarding how WSRF gathers, uses, stores, discloses and manages personal information and data. WSRF’s Privacy Policy may be found on the Website.

"Speaker" means any Person who, at the sole discretion of WSRF, is invited to deliver a speech and/or participate in a debate or panels. While speakers are planned to be present on-site in Dubai, remote presentation may be envisaged in case of COVID-related travel disruptions.

"Sponsor" means any Person who enters into a partnership agreement with WSRF concerning the organisation of the Event.

"Terms and Conditions" means these terms, conditions and rules, the Privacy Policy, and any other terms, conditions and rules brought to the attention of a Participant, including on the Website.

"Ticket" means the document issued by WSRF which entitles the Participant admission to the Event.

"VAT" has the meaning in Article 4.

“WSRF” means Word Space Risk Forum[1].

“Website” shall mean WSRF’s official website.

3. Intellectual Property, and Filming, Photography and Recordings

Participants have no right whatsoever to use, license, assign or transfer any intellectual property rights of WSRF, including, without limitation, the names, trademarks or logos of WSRF and the Event. Participants agree that any unauthorised use, licensing, assignment or transfer or any intellectual property rights of WSRF or the Event is a breach of these Terms and Conditions.

The Participants consent to being photographed, filmed or taped by WSRF, its affiliates or the Event Staff during the Event. The Participants consent that WSRF, its affiliates or the Event Staff shall have the right to broadcast, publish, and use howsoever fit any live or recorded audio, videos or photographs which contain the Participants’ image, likeness, actions and statements made at the Event in any medium or context for any purpose globally without any remuneration or other form of consideration in perpetuity.

Images, video and sound recordings of the Event taken by Participants with a media capture device such as a mobile phone, tablet, photo camera, video camera, audio equipment or device hereafter existing, cannot be used for any purpose other than for non-commercial purposes.

The Participants are advised that taking photos or shooting videos of other persons in the United Arab Emirates without their consent may be considered an invasion of their privacy and may lead to prosecution. WSRF hereby notifies all Participants that not everyone at the Event, including Event Staff, wishes to be photographed, videotaped, recorded or bothered in any manner, and any liability incurred for doing so is the Participant’s own.

4. Sponsors

Any prospective Sponsors are invited to contact the management of WSRF at hello@worldspaceriskforum.com for more details and sponsorship conditions. The sponsorship packages are available on our website - page Participate. The sponsorship conditions are defined between WSRF and a Sponsor in a separate agreement.

5. Tickets

Tickets and the classification of Participants is and shall be defined by the WSRF at its sole discretion.

The Tickets for the Attendees will be available for purchase via the Website.

The price of each Ticket shall be as set by WSRF in its sole and absolute discretion and shall be in USD, inclusive of all applicable taxes including value added tax (“VAT”), as indicated on the Website. 

Once payment in full for the Tickets has been confirmed, neither the Purchaser nor the Participant can cancel, return or resell those Tickets, save insofar as permitted by these Terms and Conditions.

If Tickets are purchased or obtained other than in accordance with these Terms and Conditions, such Tickets shall be void, together with any other Tickets held by the Participant, the Participant shall not be permitted entry to the Event, and the Participant may be asked to leave the Event without refund.

Payment, Delivery and Collection

Any and all bank or other charges incurred as a result of monetary transfer or currency conversion will be the sole responsibility of the Purchaser.

The Purchaser is solely responsible for ensuring that sufficient funds are available on the payment card and/or in the bank account utilized at the time the payment is taken by WSRF. WSRF reserves the rights to refuse any order and stop the issuance of Tickets if payment cannot be taken.

Tickets will be issued in electronic format via e-mail to the Purchaser.

Purchasers and Participant shall be solely responsible for checking the Ticket(s) purchased is(are) correct as mistakes cannot necessarily be rectified after purchase. If there has been any mistake, Purchasers and Participants must contact WSRF without delay.

Tickets shall remain the property of WSRF at all times.

Cancellation and Refunds

An event of Force Majeure may force WSRF to cancel or modify the dates and/or the time of the Event. The responsibility and liability of WSRF, its affiliates, or the Event Staff to the Participant for any failure to perform any obligation under these Terms and Conditions is expressly excluded in the presence of such event of Force Majeure. 

A full refund shall be applicable if the Event is canceled by WSRF. If the Event is postponed or shifted to a different location due to the Force Majeure, the Attendees will be offered an option of full refund.

Cancellation by Attendees without cause:

by not later than 3 weeks before the start day of the Event, in which case the refund shall be of 85% of the purchase price of the Ticket,

by not later than 10 calendar days before the start day of the Event, in which case the refund shall be of 75% of the purchase price of the Ticket,

by not later than 5 calendar days before the start day of the Event, in which case the refund shall be of 50% of the purchase price of the Ticket.

Neither party will be held liable if the contracted agreement and obligations are delayed, reduced, or prevented due to COVID-19 related reasons as communicated and instructed by Dubai Tourism, local governments, or internationally approved organisations, due to airport closures of country of origin of delegates that could not have been foreseen at the time of contracting. Provided that either party has given the other an agreed notice period with proof that COVID-19 related reasons have directly affected the Attendees or hindered the operations of the event.

Cancellations by Attendees due to Covid-19 related reasons can be accepted and refunded at 100%, provided that, the Attendee has given a proof that Covid- 19 related reasons have directly affected his/her participation in the event and written notice was sent to WSRF before Event starts.

WSRF will only accept proof of Covid-19 reasons from public and official sources 9e.g medical certificate, official travel restrictions issued by the competent Ministry or institution in the concerned country, WHO, supplier's notification of cancelled flights, trains, etc.)

Cancellation will be accepted only when a cancellation email is sent to hello@worldspaceriskforum.com from the registered email address with all relevant billing information (including name, transaction ID, etc.) and a brief comment explaining that a refund is being requested.

If and when eligible, a refund shall be provided to the relevant Purchaser via the payment method used to purchase the Ticket.

6.  Attendance at the Event, including the Event Site

The Participant must immediately notify WSRF or Event Staff present at the Event of any incident, accident or emergency or possible incident occurring at the Event and, if necessary, notify any applicable competent authority such as the police, fire or emergency services.

The Participant consents, as a mandatory condition for access to the Event, to a security inspection/screening before and/or during the entry to the Event, as well as to compliance and adherence to all sanitary and security-related policies applicable at the Event Site, including especially all Covid-19 related policies.

Personal Property

The Participant is solely responsible for the safekeeping of personal property and, as such, WSRF, its affiliates, the Event Staff or any other Person involved in the organisation of the Event do not accept any responsibility or liability for any loss, theft or damage of a Participant’s personal property while at the Event. The Participant will release WSRF, its affiliates, the Event Staff and any other Persons involved in the organisation of the Event from any liability for any loss or damage to personal property that may be suffered in relation to the attendance of the Event. 

7.  Liability

A Participant acknowledges and accepts that the Participant is responsible for its own safety. Admission to the Event, including the Event Site, is at the Participant's sole risk.

Neither WSRF, its affiliates, the Event Staff or any other person involved in the organisation of the Event accept responsibility or liability for any loss, injury or damage to person sustained within the Event, including the Event Site. If a Participant causes WSRF to incur loss, damage, costs or expense due to breach of these Terms and Conditions or otherwise, then the Participant shall be liable to WSRF for this. If a Participant causes a third party to incur loss, damage, costs or expenses due to its breach of these Terms and Conditions or otherwise, then the Participant shall be liable to the third party for this.

In no event shall WSRF, any of its officers, directors and/or employees be liable to a Participant for anything arising out of or in any way connected with attendance of the Event, including but not limited to any direct or indirect, consequential or special liability arising out of or in any way connected with attendance of the Event.

8.  General

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Dubai International Financial Centre (the “DIFC”). Any dispute or claim arising out of or in relation to these Terms and Conditions, including any transaction with WSRF, shall be finally settled by the courts of the DIFC.

If WSRF delays or fails to exercise a right or remedy or enforce any of these Terms and Conditions or those available by applicable law, it shall not mean that WSRF has waived its right to do so. A waiver of a breach of any of the Terms and Conditions or of a default under these Terms and Conditions does not constitute a waiver of any other breach or default and shall not affect the other terms of the Terms and Conditions.

These Terms and Conditions have been drafted in English. WSRF is not responsible for any translations of these Terms and Conditions into other languages. In the event of any discrepancy between the English and the translated version of these Terms and Conditions, the English version shall prevail.

WSRF reserves the right to amend these Terms and Conditions at any time and such amendment is effective from the date it is posted on the Website. By using the Website, the Participant is expected to review the Terms and Conditions on a regular basis to ensure that all the Terms and Conditions are understood.

WSRF shall have the right to assign, transfer or sub-contract its rights and obligations stipulated under the present Terms and Conditions without any notification or consent required. You may not assign, transfer or sub-contract any of your rights or obligations stipulated under the Terms and Conditions.

If any part of these Terms and Conditions is deemed by a court, tribunal or adjudicative body to be unenforceable, the remainder of these Terms and Conditions shall not be affected.
